2.4 Photo Identification & Age Verification
For the safety and security of our members and to comply with legal obligations, we reserve the right to request valid photo identification at any time.

Valid identification includes and is limited to:

  • Current passport
  • Current or provisional driving licence
  • Any other valid government-issued photographic identification

Failure to provide requested identification within 7 days may result in account suspension or termination without refund. All identification documents will be handled in accordance with UK GDPR and our Privacy Policy.

2.5 Account Security & Non-Transferability
Your account is personal to you and is NON-TRANSFERABLE and NON-ASSIGNABLE.

  • Guaranteed homepage placement
  • First access to premium castings

3.2 Producer Membership Tiers
We offer three producer membership levels:

STANDARD TIER (£99/month):

  • Search and filter performers
  • Limited contact requests (20/month)
  • Basic casting announcements
  • Standard support

PROFESSIONAL TIER (£199/month):

  • Everything in Standard
  • Unlimited contact requests
  • Featured casting announcements
  • Advanced search filters
  • Priority support

PREMIUM TIER (£299/month):

3.3 Billing Terms
All subscriptions are provided on a month-by-month basis with no fixed-term commitment.

PAYMENT PROCESSING:

  • Monthly recurring billing via Stripe
  • Payment is due on the same day each month
  • Automatic renewal unless cancelled
  • Failed payments result in immediate account suspension
  • You must keep valid payment details on file

SUBSCRIPTION CHANGES:

  • Cancellation: Takes effect at the end of the current billing period. You retain access until the period ends. No partial refunds provided.
  • Downgrade: Takes effect at the end of the current billing period. No refunds for the difference in price.
  • Upgrade: Takes effect immediately. Pro-rata charge applied for the remaining days in the current period.

3.4 Free Account Limitations
Free accounts may be subject to:

3.5 Membership Benefits Disclaimer

  • Technical limitations

4. REFUND POLICY & CONSUMER RIGHTS

4.1 Statutory Cooling-Off Period (14 Days)
Under the Consumer Contracts Regulations 2013, UK consumers have 14 calendar days from the date of purchase to cancel their subscription for a full refund.

  • Technical service failure exceeding 96 consecutive hours

All refund requests must be submitted in writing within 7 days of the issue occurring.

4.4 Charge-Backs Strictly Prohibited
Initiating a charge-back or payment dispute with your bank or card issuer instead of contacting us directly will result in:

  • Legal action to recover costs and fees
  • Breach of contract claim
  • Blacklisting from all future services

You agree to contact us first to resolve any billing disputes before initiating charge-back proceedings.

4.5 Digital Course Sales

5. COMMISSION STRUCTURE & BOOKING TERMS

5.1 Platform Commission
Climaxx Media Ltd charges a 15% commission on ALL bookings arranged through the platform or facilitated by connections made via the platform.

Commission is payable by PERFORMERS on gross booking fees and applies to:

  • Direct bookings initiated via our messaging system
  • Castings applied through the platform
  • Contacts made during active membership, even if the booking occurs later
  • Work arranged via platform connections, regardless of when performed

5.2 When Commission Is Due
Commission is payable regardless of:

  • Whether you remain a platform member at the time of the shoot
  • The payment method used by the performer and producer
  • Location of production or shoot
  • How much time has elapsed since initial contact

If the connection was made via our platform, a commission applies.

5.3 Commission Reporting & Payment
REPORTING REQUIREMENT:
Performers must report all bookings made through platform connections within 7 days of the shoot’s completion. Failure to report bookings is a material breach of these terms.

PAYMENT TERMS:

  • Commission invoice issued within 7 days of reported booking
  • Payment due within 14 days of invoice date
  • Late payment incurs 8% annual interest (statutory rate)
  • Non-payment results in account suspension and legal collection

5.4 Platform’s Role In Payments
IMPORTANT: We are NOT a party to the payment contract between the performer and the producer.

We do NOT:

  • Hold funds in escrow
  • Process payments between performers and producers
  • Guarantee producer payment to performers
  • Mediate payment disputes
  • Enforce payment terms between parties
  • Provide payment protection

You agree to settle all booking payments, rates, terms, and conditions directly with the other party. Our commission is separate and independent from your private arrangements.

5.5 Non-Payment Consequences
Non-payment of platform commission will result in:

  • Immediate account suspension
  • Profile removal from search results
  • Loss of all membership benefits
  • Referral to a debt collection agency
  • Legal action to recover outstanding amounts
  • Permanent account termination

6. NO GUARANTEE OF WORK, BOOKINGS, OR EARNINGS

6.1 Marketplace Reality
Climaxx Media Ltd operates as a Producer & marketplace connecting performers with producers. Membership provides:

✓ Access to casting opportunities
✓ Search functionality based on membership tier
✓ Ability to receive and respond to booking requests
✓ Platform tools and features

Membership DOES NOT guarantee or promise:
✗ Any bookings whatsoever
✗ Any specific number of opportunities
✗ Any level of income or earnings
✗ Response from producers to applications
✗ Selection for any casting or project
✗ Minimum profile views or impressions
✗ Specific search ranking or placement
✗ Any work or employment of any kind

6.2 Success Factors Outside Our Control
Your booking opportunities and success depend on numerous factors entirely outside our control, including but not limited to:

MARKET FACTORS:

  • Overall industry demand
  • Economic conditions affecting production budgets
  • Seasonal variations in production schedules
  • Geographic location and regional demand
  • Market saturation and competition

PERSONAL FACTORS:

  • Quality and professionalism of your profile
  • Your rates and fee expectations
  • Your availability and flexibility
  • Your physical characteristics and specialities
  • Your reputation and prior work experience
  • Your communication and professionalism
  • Producer preferences and subjective opinions

COMPETITIVE FACTORS:

  • Number of performers in your category
  • Quality of competing profiles
  • Pricing strategies of other performers
  • Established relationships between producers and other talent

6.3 Realistic Expectations
The UK & European adult industry is highly competitive. Platform statistics show:

  • Some members receive regular bookings
  • Some members receive occasional bookings
  • Some members receive few or no bookings

Past performance of other members is NOT indicative of your likely results. We make NO representations, warranties, or promises about:

  • Potential earnings or income
  • Success rates or booking frequency
  • Return on membership investment
  • Career advancement or opportunities

6.4 Training Courses
Our training courses are educational products designed to improve industry knowledge and professional skills.

Course completion:

  • May improve your understanding of the industry
  • May improve your casting consideration
  • Does NOT guarantee work offers
  • Does NOT create an employment relationship
  • Does NOT entitle you to bookings or opportunities
  • Does NOT guarantee success in the industry

6.5 No Employment Relationship
Membership does NOT create:

  • Employment relationship with Climaxx Media Ltd
  • Fiduciary relationship
  • Agency representation
  • Obligation to offer work
  • Partnership or joint venture
  • Any form of employment contract

All work arrangements are between independent contractors and are your sole responsibility.

7. PRODUCER VETTING & VERIFICATION

7.1 Basic Verification Process
We conduct limited verification of producer accounts, which may include:

  • Companies House registration verification (for UK companies)
  • VAT number validation (if applicable)
  • Review of published work portfolio
  • Identity verification documents
  • Basic legitimacy checks

7.2 Critical Limitation of Verification
This verification is EXTREMELY LIMITED IN SCOPE and does NOT constitute:

  • Endorsement, recommendation, or approval
  • Guarantee of legitimacy, professionalism, or trustworthiness
  • Assurance of payment capability or reliability
  • Investigation of reputation, history, or complaints
  • Background check, DBS check, or criminal record check
  • Financial stability or credit verification
  • Verification of all claims or credentials
  • Due diligence on business practices

7.3 Verified Badge Does Not Mean “Safe” or “Recommended”
A “verified” badge means only that basic identity documents were provided. It does NOT mean:

  • This producer is safe to work with
  • Payment is guaranteed
  • The producer has a good reputation
  • No complaints have been received
  • The producer meets any quality standards

7.4 Performer’s Sole Responsibility
You remain 100% SOLELY RESPONSIBLE for:

  • Researching producers before accepting bookings
  • Conducting your own due diligence
  • Verifying credentials and legitimacy independently
  • Negotiating safe working conditions
  • Ensuring compliance with all laws
  • Protecting your personal safety and well-being
  • Making informed decisions about work acceptance

7.5 Recommended Safety Practices
We strongly recommend performers:

  • Research the producer’s reputation independently
  • Request references from other performers
  • Meet in a public location first (e.g., coffee, etc.).
  • Review the full contract before signing
  • Never pay fees to producers
  • Inform a trusted person of the shoot location and schedule
  • Trust your instincts – decline if uncomfortable
  • Verify identity and location before attending the shoot
  • Bring a chaperone or companion if allowed

7.6 No Liability For Producer Actions
We accept ZERO LIABILITY for:

  • Actions, conduct, or behaviour of any producer
  • Payment disputes or non-payment by producers
  • Safety incidents, harm, or injury during productions
  • Breach of contract by producers
  • Misrepresentation or fraud by producers
  • Working conditions or treatment
  • Content usage or intellectual property disputes
  • Any loss, harm, or damage arising from bookings

Verification provides limited identity confirmation only. You assume ALL RISKS when accepting bookings via the platform.

8. PROHIBITED CONTENT & USER CONDUCT

8.1 Strictly Prohibited Content
The following is ABSOLUTELY FORBIDDEN on all profiles, uploads, communications, and platform usage:

ILLEGAL CONTENT – ZERO TOLERANCE:

  • Child sexual abuse material (CSAM) or any content involving minors
  • Content depicting or promoting child exploitation
  • Bestiality or animal sexual abuse content
  • Non-consensual content (revenge porn, hidden cameras, sextortion)
  • Extreme violence, torture, or serious bodily harm
  • Content depicting or promoting illegal acts
  • Content violating UK criminal law or international law
  • Human trafficking or forced labour content

PLATFORM ABUSE:

  • Spam, unsolicited marketing, or bulk messaging
  • Malware, viruses, or phishing attempts
  • Impersonation of other persons or entities

COMMERCIAL VIOLATIONS:

  • Advertising competing services or platforms
  • Attempting to circumvent the commission structure
  • Sharing personal contact details to bypass the platform
  • Soliciting off-platform payment or direct payment
  • Selling or transferring account access
  • Creating multiple accounts to abuse the system

8.2 Content Standards
All content must:

  • Be legally created and owned/licensed by you
  • Feature only consenting adults aged 18+
  • Comply with UK law and international standards
  • Be relevant to the adult industry professional purposes
  • Not contain misleading or deceptive claims

8.3 Enforcement & Consequences
FIRST VIOLATION (Minor):

  • Written warning
  • Content removal
  • Temporary feature restriction

REPEAT VIOLATION:

  • Account suspension (7-30 days)
  • Loss of membership benefits during suspension
  • No refund for the suspension period

SERIOUS VIOLATION:

  • Immediate permanent account termination
  • No refund of any fees paid
  • Blacklisting from future platform access
  • Reporting to the relevant authorities

CRIMINAL CONTENT:

  • Immediate termination and permanent ban
  • Preservation of evidence
  • Mandatory reporting to law enforcement
  • Full cooperation with the criminal investigation
  • Potential civil and criminal liability

8.4 User Reporting
You agree to immediately report any prohibited content or conduct observed on the platform. Failure to report may result in account restrictions.

8.5 Indemnification
You agree to indemnify, defend, and hold harmless Climaxx Media Ltd, its directors, officers, employees, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:

  • Your content or conduct on the platform
  • Your violation of these terms
  • Your violation of any law or third-party rights
  • Claims by third parties related to your profile or actions

8.6 Content Review & Moderation Process
We reserve the right to review all content both before and after upload to ensure conformity with these Terms and our content guidelines.

CONTENT REVIEW:

  • All uploaded content may be subject to pre-approval review
  • Content may be reviewed at any time post-upload
  • Review typically occurs within 24-48 hours of upload
  • We may use automated and manual review processes

CONTENT REJECTION OR REMOVAL:
If content is declined or removed, we will notify you via:

  • The platform interface notification system, OR
  • Email to your registered email address

Where reasonably possible, we will provide transparency regarding the reason for content decline or removal.

APPEALS PROCESS:
You may appeal content decisions by:

  • Submitting an appeal via the platform interface, OR
  • Contacting support@climaxxmedia.com with “Content Appeal” in the subject line
  • Providing additional context or information supporting your appeal

We will review appeals made on reasonable grounds; however:

  • All content moderation decisions by Climaxx Media staff are FINAL
  • We are under no obligation to reverse decisions
  • Repeated appeals of the same decision may be ignored
  • Abusive or threatening appeals will result in account action

IMPORTANT LIMITATION:
The acceptance or approval of content at the point of upload does NOT guarantee its permanent presence on the platform. We reserve the right to remove previously-approved content if we:

  • Retrospectively determine that it contravenes our terms or guidelines
  • Update our content guidelines or terms
  • Receive valid complaints from third parties
  • Determine removal is necessary for legal, safety, or reputational reasons

Content removal does not entitle you to any refund or compensation.

9. PLATFORM LIMITATIONS & NO MEDIATION SERVICE

Climaxx Media Ltd operates as a NEUTRAL TECHNOLOGY PLATFORM connecting two independent parties. We are merely a venue for connections.

We are NOT:
❌ An employer or employment agency
❌ A personal talent agent representing either party
❌ A party to contracts between performers and producers
❌ A mediator, arbitrator, or dispute resolver
❌ Responsible for the enforcement of agreements between users
❌ A guarantor of payment, performance, or conduct
❌ A legal advisor or compliance consultant

9.2 No Mediation Service Provided
WE DO NOT MEDIATE DISPUTES between performers and producers.

If you have a dispute with another platform user, you must:

  • Resolve it directly with the other party
  • Seek independent legal advice if necessary
  • Use appropriate legal channels (courts, arbitration)
  • Take personal responsibility for the resolution

We will NOT:

  • Mediate or arbitrate disputes
  • Provide opinions on dispute merits
  • Recommend outcomes or solutions
  • Share user contact details for legal service (except by court order)
  • Testify or provide evidence (except by court order)
  • Take sides in user disputes

9.3 Common Disputes We Do Not Mediate
Examples of disputes between users that we DO NOT resolve:

PAYMENT DISPUTES:

  • Non-payment by the producer to the performer
  • Disputed payment amounts or rates
  • Cancellation fees or penalty charges
  • Expense reimbursements
  • Payment timing or method

CONTRACT DISPUTES:

  • Breach of booking agreement
  • Content usage rights or model releases
  • Copyright or intellectual property claims
  • Confidentiality or NDA violations
  • Performance standards or quality

WORKING CONDITION DISPUTES:

  • Safety concerns or incidents
  • Treatment or conduct during shoots
  • Scope creep or additional requests
  • Travel arrangements or accommodation
  • Schedule changes or cancellations

These are PRIVATE CONTRACTUAL MATTERS between you and the other party.

9.4 Reporting Terms of Service Violations
You MAY report users for violations of OUR platform terms, including:

  • Prohibited content
  • Platform abuse
  • Fraud or scams
  • Harassment or threatening behaviour
  • Payment of platform commission (performers only)

We will investigate reported violations and may take action against accounts violating our terms. This is NOT mediation – this is enforcement of platform rules.

9.5 User Ban Requests
We will NOT ban users simply because you had a dispute with them. Bans are issued only for violations of platform terms, not personal disagreements.

9.6 User Report & Investigation Process
If you have a report or complaint about another member’s conduct or content on the platform, you should submit it through our reporting system.

REPORTING PROCEDURE:

  • Use the built-in reporting feature on the platform, OR
  • Contact support@climaxxmedia.com with “User Report” in the subject line
  • Provide as much detail as possible regarding your report
  • Include screenshots, messages, or other evidence if available

INVESTIGATION TIMELINE:

  • We endeavour to begin investigating reports within 1 working day
  • We aim to provide feedback on reports within 5 working days
  • Complex investigations may take longer

INVESTIGATION SCOPE:
When we review your report, we will do so primarily based on:

  • Information provided by you in the report
  • Information available to us via the platform interface
  • Platform logs and records
  • Content visible on user profiles

If you have additional information that may support your report, you MUST make it available to us as soon as reasonably possible via the support system.

INVESTIGATION OUTCOMES:
Possible outcomes of investigations include:

  • No action (insufficient evidence or no violation found)
  • A warning was issued to the reported user
  • Content removal
  • Temporary account suspension
  • Permanent account termination

We will notify you of the outcome where appropriate, but may not disclose specific actions taken due to privacy considerations.

ESCALATION:
If you remain dissatisfied with our response to your report, you may escalate via complaints@climaxxmedia.com, clearly labelling it as an escalated complaint and providing a detailed overview.

Escalated reports will be handled by senior management and reviewed within 10 working days.

IMPORTANT LIMITATIONS:

  • We investigate platform terms violations only
  • We do NOT investigate or resolve contract disputes between users
  • We do NOT provide evidence for legal proceedings (except court order)
  • Investigation findings are at our sole discretion and are FINAL
  • We reserve the right to close reports without investigation if frivolous or abusive

10. ACCOUNT TERMINATION & SUSPENSION

10.1 Our Right to Terminate or Suspend
We reserve the absolute right to suspend or terminate any account at any time, with or without notice, for any reason, including:

SERIOUS VIOLATIONS (Immediate Termination):

  • Prohibited content or criminal activity
  • Fraud, deception, or material misrepresentation
  • Harassment, threats, or abusive conduct
  • Circumventing commission structure
  • Multiple terms violations
  • Harm to platform’s reputation or other users

PAYMENT ISSUES (Suspension Until Resolved):

  • Non-payment of subscription fees
  • Non-payment of commission owed
  • Charge-back or payment disputes
  • Fraudulent payment methods

OPERATIONAL REASONS:

  • Prolonged inactivity (180+ days for free accounts)
  • Capacity management
  • Quality control
  • Change in business model
  • Legal or regulatory requirements
  • Any other reason at our sole discretion

10.2 Termination Process
IMMEDIATE TERMINATION:
Serious violations result in immediate permanent termination without warning or notice.

PROGRESSIVE DISCIPLINE:
Minor violations may follow progressive discipline:

  1. Written warning
  2. Temporary suspension (7-30 days)
  3. Permanent termination

10.3 Effect of Termination or Suspension
Upon termination or suspension:

  • All platform access is immediately revoked
  • Profile is removed from public view
  • All membership benefits cease
  • NO REFUNDS provided for the remaining subscription period
  • Outstanding commission fees remain payable
  • User data may be permanently deleted after 30 days
  • You may not create new accounts without express permission

10.4 Free Account Termination
Free accounts may be terminated at any time for any reason without notice or compensation, including:

  • Inactivity for 180+ consecutive days
  • Poor quality, incomplete, or unprofessional profiles
  • Capacity management or database pruning
  • Suspected duplicate or fraudulent accounts
  • Any operational or business reason

10.5 Post-Termination Obligations
Even after termination, you remain obligated to:

  • Pay all outstanding commission fees
  • Comply with confidentiality obligations
  • Refrain from disparagement
  • Do not create new accounts without permission
  • Comply with all surviving terms

10.6 No Right to Appeal
